Employer Eligibility – Subclass 482 Temporary Skill Shortage

For Australian employers looking to fill critical skill shortages quickly

The 482 visa allows businesses to sponsor skilled overseas workers when suitable local talent cannot be found.

Become a Standard Business Sponsor (SBS)

Before sponsoring a worker, an employer must be approved as a Standard Business Sponsor.

This requires:

  • Evidence of lawful, active business operations
  • A commitment to training Australians (no longer measured through the old training benchmark, but via general compliance history)
  • No adverse information (immigration breaches, Fair Work violations, sanctions)
  • Agreement to meet sponsorship obligations

Genuine Position Requirement

To be eligible, the role must be:

  • A genuine, full-time, ongoing position
  • Essential to your business operations
  • Matched to an occupation on Australia’s Skilled Occupation Lists (STSOL / MLTSSL / ROL)
  • Supported by evidence showing the need for the role

Common examples for 482 include:
Chefs, Cooks, Carpenters, Aged Care Managers, Customer Service Managers, ICT roles, Accountants, Auto Mechanics, Marketing Specialists, etc.

Labour Market Testing (LMT)

Most 482 visas require employers to prove they attempted to hire locally.

This means:

  • Advertising the job in Australia for 4 weeks
  • Using approved platforms (e.g., Workforce Australia + 2 major job boards)
  • Keeping evidence of job ads and responses


Offer a Market Salary that Meets TSMIT

Employers must offer a salary that is:

  • At or above the Temporary Skilled Migration Income Threshold (TSMIT): $73,150
  • Equal to what an equivalent Australian employee would earn
  • Compliant with all Fair Work requirements
